The case rests on the quarterly report issued around 1 September, which recorded no Iranian information about declared facilities during the reporting period, no inspector access since June, and no precise location for the fourth declared enrichment plant at Isfahan 4. That evidence was already three weeks old on the day of the vote. The referral changed the building the file sits in, not the case inside it.

For twenty years the file has been handled by censure inside the Board in Vienna. The resolution instructs Director General Rafael Grossi to carry the Board's concerns to the Security Council and to the General Assembly 5. Support ran to 66 per cent of the Board, yet the two capitals that can stop anything in New York were among the three voting against, and both hold Council vetoes. Iran's ambassador to the agency, Reza Najafi, told the Board that inspections were impossible during a war and that Iran had not suspended its safeguards duties 6. Both statements can hold at once: the agency cannot weigh a stockpile it cannot reach, and a state under bombardment has a reason of its own for keeping inspectors away from the sites being bombed.

The timing carries a problem the vote does not solve. The Council's own Iran monitoring body, the 1737 Panel of Experts, created by the resolution that followed Iran's last referral in 2006, loses its mandate on Saturday 26 September, and no renewal text had reached the public record by 11 September 7. The Panel is the Council's technical reporting team, up to eight experts whose work is to document how the measures are being evaded 8. Its lapse would leave the measures in law with nobody assigned to check them. The Council takes delivery of Iran's file weeks before it loses the body equipped to investigate it, so the referral buys a record rather than an instrument, and a record is worth having only if somebody reads it later.
