Spain prices the owner, not the listing

Spain re-enacted its seasonal-let rules by decree four days after Congress rejected them, and added a property-tax surcharge that rises with the number of tourist flats an owner holds. Barcelona adopted it within days. Poland's lower house voted to let neighbours ban short lets in their building, and Ireland tied registration to planning. Mexico's deputies voted to send most of the country's visitor fee to the Defence Ministry, and Shinjuku moved to ban new home-shares.

Key takeaway

Governments have moved from registering short-let listings to taxing, zoning and restricting the people who own them.

Spain's cabinet reissued its rental rules on 6 October, four days after Congress threw them out. Town halls may now raise property tax by up to 150% for owners of four or more tourist flats.

Barcelona moved first, with final approval due in December. Everything rests on a 69-seat standing committee approving the decree before the 29 November election.

Mexico's deputies cut the rise in the fee paid by foreign visitors who are not exempt to 17.8%, then handed the defence ministry 57% of it. Senate committees have approved the law; the plenary has not voted.

Mexico's lower house voted on 13 October to raise the fee paid by foreign visitors who are not exempt to 1,158 pesos, up 17.8%. Senate committees backed the law on 21 October, but the full Senate has not voted.

The cut from the government's 1,334.80 pesos came out of the migration agency's share. The Defence Ministry would still take 57%, about 660 pesos a visitor.

Poland's Sejm voted 407 to 24 to let a housing community ban short lets in its own building from 2028. The bill now goes to the Senate.

Poland's Sejm voted 407 to 24 on 8 October for a short-let law, which now goes to the Senate. If enacted, the bill would require a national register number for flats let for under 30 days.

The bill would let neighbours vote to ban short lets in their building from 1 January 2028. It would supply the statutory basis the Supreme Court found missing in 2021.

Ireland's government published a Short Term Letting and Tourism Bill on 6 October. Hosts letting for 21 nights or less must register with Fáilte Ireland and declare their planning status first.

Hosts in towns and villages below 20,000 residents have two years to obtain permission. The Oireachtas, Ireland's parliament, still has to pass the Bill.

Shinjuku City, the Tokyo ward with more registered home-shares than any other Japanese municipality, wants to bar new ones across its residential districts.

Tokyo's Shinjuku ward wants to stop new home-share lets across almost all its residential districts. Public comment opened on 15 October and runs to 13 November.

The ward counts 3,749 such lets, the most of any Japanese town. Owners living on site could still host guests in school holidays, for up to 120 days a year.

Indonesia's anti-corruption prosecutors filed Silmy Karim's case with Jakarta's corruption court on 19 October. The former deputy immigration minister faces allegations of extorting foreigners who applied for residence permits.

The case began with a June sting at a Jakarta immigration office. The first hearing is scheduled for 29 October at 10:00 WIB; the charges remain untested.

Bank Tabungan Negara, a state lender, signed a memorandum on 9 October to explore digital collection of Bali's Rp150,000 tourist levy. Bali took Rp235bn from the levy in January to August 2026.

Only 35.4% of foreign visitors paid in 2025, Antara reported. Bali cannot turn visitors away at the airport, so it keeps adding ways to pay.

The Assemblée nationale finance committee voted to end depreciation relief on new tourist lets, then threw out the budget's whole revenue half.

France's National Assembly finance committee voted to end depreciation relief on tourist lets bought from 2027. On 9 October it then rejected the budget's whole revenue half, 31 votes to 3.

That second vote wiped out the amendment. Debate in the full house restarted from the government's own text, which reportedly caps the relief instead of ending it.

Closing comments

Direction: up in Spain, pending in Mexico and Poland. The Spanish hinge is the Diputación Permanente, where the Partido Popular, Vox and Junts hold 34 of 69 seats, one short of a majority, and Congress has not fixed the session date. A rejection would void RDL 29/2026 and with it the power behind Barcelona's surcharge. In Mexico the Senate plenary must still vote on the fees law, and any change to the fee would return it to the Chamber of Deputies. In Poland the Senate can amend or keep the housing-community ban before the act reaches the president.

Apartur said it will sue Barcelona City Council if the December plenary confirms the IBI surcharge on tourist flats, which director general Marian Muro called disproportionate. The top band falls on owners of four or more, who hold about 6,000 of the city's roughly 10,600 tourist flats.

The IGHP warned that aparthotels could be caught by the municipal short-let zones in the act the Sejm passed on 8 October. Aparthotels sit between hotel and flat, and the act makes every stay under 30 days a regulated hotel service.

Burke presented the Short Term Letting and Tourism Bill on 6 October, making Fáilte Ireland the register authority and planning compliance a condition of registration. Hosts in places under 20,000 people get two years to regularise.
