Key takeaway

USTR's 2027 trade barrier docket closes on 29 October and names the European Union among its markets.

The Office of the United States Trade Representative (USTR) published a request for comments on 14 September 2026 for the 2027 National Trade Estimate report, docket USTR-2026-0498, closing on 29 October 2026 1. The notice names the European Union among its export markets and invites comment on barriers to cross-border data flows and other restrictive technology requirements. The National Trade Estimate is Washington's annual catalogue of foreign practices American exporters object to, and US industry associations have used those categories before to nominate the Digital Markets Act (DMA), the Digital Services Act and the AI Act.

USTR opens this window every year, so reading it as an escalation would mistake routine machinery for a new front. It builds a record instead. Comments not used in the 2027 report are retained, in USTR's own wording, for potential use in future discussions or negotiations with trading partners. A submission filed in October therefore stays available to a negotiator who has not been appointed yet.

Donald Trump ordered an investigation into EU digital rules on 24 July under Section 301, the US trade law authorising unilateral tariffs . This topic traced that order through the Federal Register in early August and found no docket number, no notice and no comment period on the public record . September's request carries all three, which makes the routine instrument the one currently open to European respondents and the extraordinary one still invisible.

Three days separated the fortnight's two filings. Brussels wrote a new duty for anyone selling software into the single market; Washington opened the ledger where its own industry writes down which European duties it objects to.

Deep Analysis

In plain English

The National Trade Estimate is an annual US report listing foreign rules the government sees as barriers to American exporters. The US Trade Representative has now opened a public comment period asking American companies for evidence that EU digital rules, such as the Digital Markets Act, hurt their business. This does not itself impose any tariff. It is a data-gathering step that could feed into a future US trade action against the EU, on top of a separate investigation Washington already opened in July.

Deep Analysis
Root Causes

June's EU-US tariff deal capped most tariffs at 15% but explicitly excluded digital services taxes and platform-enforcement fines , leaving DMA and DSA enforcement as the one unresolved file from that agreement. The NTE listing reopens exactly that carve-out rather than starting a new dispute.

Donald Trump's July order for a Section 301 investigation into EU digital rules already put USTR on this track two months before the NTE window opened, so the September step is procedural continuity, not a fresh escalation on its own.

UKMTO counted about 20 US-facilitated Hormuz transits a day to 11 September against only 6 visible on AIS, with traffic still around 90% below the 138-a-day pre-war baseline. War-risk underwriters cannot price hulls they cannot see, or resolve whether the tanker El Gaia hit a mine, as Iran claims, or a missile and drone, as CENTCOM says.
European refiners
European refiners
European refiners, including Poland's Orlen, absorbed a roughly $26 gap between Dated Brent at $130.80 on 15 September and ICE Brent futures settling at $103.87 on 18 September, a spread that widened from $13.45 on 9 September rather than newly opening. Their futures hedges no longer cover what they now pay for physical barrels.

Saudi Aramco zeroed European term customers' October allocations and rerouted roughly 60 million barrels to Asia through Ras Tanura and Sohar, using Red Sea and Gulf terminal capacity built years ago to cut Hormuz exposure. Riyadh reallocated existing supply rather than negotiating a shortfall with Europe.

Qatar's energy minister Saad al-Kaabi told Bloomberg at the Qatar Economic Forum on 20 September that Bessent's two-year Hormuz-obsolescence forecast is wrong, and that Doha has deliberately built no bypass pipeline. Qatar's gas exports run through one waterway by choice, not oversight.

Iran's foreign ministry and 130 Majlis deputies moved toward NPT withdrawal this week, with lawmaker Hossein-Ali Haji Deligani filing a triple-urgency bill on 20 September that Speaker Qalibaf has not yet scheduled. Tehran treats treaty membership as leverage still on the table, not yet spent.

Moscow and Beijing vetoed the Panel of Experts' renewal, maintaining Resolution 2231 lapsed in October 2025 and the 2025 snapback was never validly triggered, so the sanctions architecture the Panel enforces has no current legal standing. Both governments frame the veto as upholding law, not shielding Tehran.
