Georgia transmitted its first military and overseas ballots of the cycle on 15 September, four days inside the federal floor 1. That floor comes from the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA), which since the MOVE Act of 2009 has required ballots to reach service members and citizens abroad 45 days before polling day. For 3 November 2026 the count lands on Saturday 19 September.
Michigan's bureau of elections told clerks on 31 August that the date does not roll forward to the following Monday the way other election deadlines do, and instructed any jurisdiction expecting to miss it to notify the state, naming litigation delay and ballot printing as example causes 2. A state that misses Saturday has missed it, whatever a court decides the week after. Michigan wrote that bulletin eight days before Missouri's map reversal and described the danger without naming a state.
South Carolina missed the same class of federal deadline in July and signed a Memorandum of Agreement with the Justice Department to manage the fallout . That is the remedy on offer: a negotiated clean-up with the federal government, agreed after the ballots failed to go out.
