What is the Responsible Data Center Development Act?
Background
The Responsible Data Center Development Act (A11560/S10642) is a New York State bill sponsored by Senator Kristen Gonzalez. The Assembly passed it 102-39 and the Senate 44-16 on 4 June 2026, in the final hours of the legislative session. It awaits Governor Kathy Hochul's signature as of 7 July 2026; her office has not stated a position.
The bill imposes a one-year freeze on state environmental permits for data centres with peak demand of 20 MW or more, creates a separate large-load utility rate class, requires an 18-month environmental impact review framework, and sets renewable-energy targets of one-third by 2030. If Hochul signs it, New York becomes the first US state with a statewide data-centre moratorium in effect; Maine passed a similar bill but its governor vetoed it.
