The Fuero Nuevo, formally the Compilación del Derecho Civil Foral de Navarra, is Navarra's own body of civil law, held separately from Spain's national civil code under the community's historic foral competence. It covers FAR more than tenancy matters, but its provisions on room rentals have become its most prominent current application .
Laws 587 to 596, recast by Ley Foral 21/2019, first excluded room rentals from Spain's Ley de Arrendamientos Urbanos, leaving them to free contract. Ley Foral 11/2026 now replaces that gap with a full regime while continuing to draw its authority from the Fuero Nuevo rather than the state act.
As the basis of Navarra's legislative autonomy on this issue, the Fuero Nuevo is also the model other foral communities, Aragon, the Balearic Islands, Catalonia, Galicia and the Basque Country, would need to invoke if they chose to follow suit.
Fuero Nuevo now governs room rentals
Laws 587 to 596 of the Fuero Nuevo, recast by Ley Foral 21/2019, had excluded room rentals from Spain's national tenancy act, leaving them to free contract. Ley Foral 11/2026, passed 2 July 2026 and gazetted 28 July, replaces that free-contract gap with a full three-category regime and a twelve-month auto-conversion rule .
The change matters for the Fuero Nuevo specifically because it continues to draw its authority from Navarra's own historic civil-law competence rather than from the state tenancy act. Five other Spanish communities share that same underlying competence but have not yet used it this way.
