Background
The State Corporation Commission is Virginia's independent regulatory body, established under the state constitution, overseeing utilities, insurance, banking and corporations operating in the Commonwealth. It licenses and supervises the electric, gas and telecommunications utilities that Virginia residents and businesses rely on.
From September 2026 the Commission administers a new $0.011 per kWh electricity consumption tax on Virginia data centres, collecting monthly and refunding any amount above a $600 million annual cap pro rata to operators. It must issue implementation guidelines within 60 days of enactment covering reporting, payment and refund procedures, and the tax is due to expire 30 June 2028 absent legislative extension.
