Background

Lei 23/2007 of 4 July 2007, passed by the Assembleia da República, sets Portugal's legal regime for the entry, stay, exit and removal of foreigners. It covers visas, residence permits and family reunion, and is commonly called the Lei de Estrangeiros.

It has been amended many times, by Decreto-Lei 41/2023 among others, and most recently by Lei 62/2026, in force from 11 September 2026. That law transposes the EU's Pact on Migration and Asylum and the recast Single Permit Directive.

AIMA, the Agency for Integration, Migration and Asylum, decides residence applications under it: 60 days for a renewal and 90 days for a first grant, with a 30-day extension in exceptional cases. Since Lei 62/2026 revoked Article 82(7), a missed renewal Deadline no longer produces a permit by default.
