Background

New York's Department of Environmental Conservation will draft a Generic Environmental Impact Statement (GEIS) during the one-year moratorium on discretionary hyperscale data-centre permits that Governor Kathy Hochul ordered on 14 July 2026.

A GEIS is a single broad environmental review covering an entire class of projects, rather than a separate review for each individual site. Using one for hyperscale data centres lets the DEC set standard conditions, such as water use, noise and grid impact thresholds, that would otherwise be assessed piecemeal, project by project.

The document is intended to let permitting resume on a more predictable footing once the freeze lifts, giving the state time to study the cumulative grid and environmental impact of hyperscale growth before approving the next wave of projects.
